The US District Court for the Northern District of California has granted Mentor's motion for summary judgment of infringement against Cadence Design Systems.

The US District Court for the Northern District of California has granted Mentor's motion for summary judgment of infringement against Cadence Design Systems In a 14 page opinion entered in Case 00-3291 SI, the court found that the Cadence MercuryPlus product infringed both claims of US Patent 5,574,388 that were the subject of Mentor's motion

This order follows on the heels of the same court's recent denial of a summary judgment motion brought by Cadence to dismiss the patent case for lack of standing.

"We are certainly pleased that the court agreed with us that the MercuryPlus product infringes the '388 patent", said Dean Freed, general counsel of Mentor Graphics.

"We believe just as strongly that the five other patents in this case are infringed by Cadence's Mercury and MercuryPlus product and, following the court's claim construction rulings to be announced in the near future, we may move for summary judgment of infringement on one or more of these patents as well.

A trial of the remaining issues in this case, including Mentor's theft of trade secrets claim, is set for October of this year.

We look forward to finally being able to present our facts to a jury".
